An effects-based jurisdiction — if your AI touches Kenyans, you answer to Kenyan rules — is a genuinely bold move for a country without the market size of the EU, which pioneered the same approach.
But the EU has enforcement teeth: a legal presence requirement, a massive market companies can't afford to lose, and a bureaucracy built to pursue non-compliance across borders. Kenya has none of those yet.
The most consequential clause in this draft isn't the extraterritorial reach. It's the procurement rule: global AI companies that want Kenyan government contracts must partner with local Kenyan firms. That's leverage Kenya actually holds.
