
Kenya's New Crypto Capital Requirements Threaten to Push Startups Out
New Kenyan regulations imposing capital requirements on crypto businesses are putting homegrown startups under significant financial pressure, with analysts warning that some operators may be forced to relocate or shut down ahead of the compliance deadline.
Kenya Crypto Rules: the sequencing trap is what kills you, not the numbers
The headline figures look manageable until you read the order in which they hit. To raise institutional money, a Kenyan crypto startup needs a licence. To get the licence, it needs Sh100–300 million in paid-up capital first.
That's the trap: you can't fundraise your way to compliance if compliance is the prerequisite for the fundraise.
The Virtual Assets Chamber of Commerce has pushed for tiered requirements — smaller safeguards for smaller, narrower businesses — which is the logical fix. A seed-stage payment processor does not carry the same risk as a large exchange holding customer assets. Kenya's framework doesn't yet make that distinction.
South Africa and Mauritius already do. That's why founders are looking at the door.
