Data Rollover: the EFF's anger is real, but it may not move the courtroom
The EFF is right that MTN and Vodacom are defending a system where customers pay for data they then lose. That's not spin — it's how bundle expiry works.
But political condemnation and a successful legal challenge are completely different contests. MTN's actual court filing targets specific procedural questions: whether ICASA exceeded its powers, whether the rules are clear enough to implement, whether mandatory transfers could create resale problems. Those are technical legal arguments, and they don't get weaker just because a party attacks them loudly in a press statement.
The consumer waiting for the January 2027 rules to kick in needs a court to reject those arguments on their merits — not a political party to win a news cycle.
