MTN and Vodacom have taken South Africa's communications regulator ICASA to court to challenge its data-expiry rules, in a case that could set a precedent for consumer data policy across the continent. The legal battle places consumer rights directly in tension with telco commercial models in Africa's largest mobile market.
Data War: suing the regulator is the operators' strongest move, and its weakest argument
MTN and Vodacom are using the courts to fight a rule they helped make inevitable.
The case may well succeed on technical grounds — regulations can be challenged for procedural flaws regardless of their merit. A legal win, though, is not the same as a moral one.
The consumer waiting for their data to stop disappearing at midnight doesn't much care who wins the argument. They care whether the outcome changes their bill.
