Kenya's first comprehensive cryptocurrency licensing framework is now gazetted and legally in force, establishing regulatory requirements for one of Africa's largest digital-asset markets. The rules prioritise financial stability, with questions remaining about how the framework will balance innovation for the sector.
Kenya Crypto: treating startups like banks will decide who gets to play
The detail that settles the debate is buried in the capital requirements: Kenya has deliberately placed crypto businesses inside a prudential framework — the same supervisory logic applied to licensed banks and fund managers, not to technology startups.
That's a clear philosophical choice. And it may be defensible — Kenya's FATF grey-list exit gave policymakers a real reason to demonstrate serious oversight, not symbolic rules.
But a startup building a local stablecoin or a small exchange now faces bank-grade governance obligations. Treasury did reduce some draft capital thresholds after industry feedback, which matters. Whether what remains is genuinely proportionate for an early-stage Kenyan founder — or only survivable for a well-resourced foreign entrant — is the question this framework will answer in practice.
